1. Agreement
By accessing or using HearthWrite, you agree to these Terms. If you do not agree, do not use the service.
2. The service
HearthWrite is a platform for reading, writing, and sharing fiction and related community features (profiles, libraries, prompts, collections, messaging, and similar tools we may add). Features may change over time.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use online services). If you are under 18, you confirm a parent or guardian consents to your use. Some content on the site may be intended for mature audiences; use judgment and account settings/labels accordingly.
4. Accounts
You are responsible for your account credentials and for activity under your account. Provide accurate registration information and keep it updated. We may suspend or terminate accounts that are compromised, abusive, or create serious risk to other users or the service.
5. Your content (liberal default)
You own the stories, comments, profile text, images, and other material you post (“Your Content”).
What we allow. HearthWrite is built for creative expression. We do not try to police taste, genre, politics, religion, sexuality, darkness, violence in fiction, or unpopular ideas. Mature, erotic, dark, experimental, and controversial fiction are generally allowed when posted as creative work.
What we do not allow. We may remove content or restrict accounts that involve:
- Illegal activity or content that is unlawful where we operate
- Child sexual exploitation or abuse material (CSAM), including any sexual content involving minors (fictional or real)
- Credible threats of real-world violence, doxxing, or targeted harassment of real people
- Non-consensual intimate imagery of real people
- Malware, phishing, or attempts to break or abuse the service
- Spam, scams, or deceptive commercial bulk posting
- Clear infringement of someone else’s copyright or trademark when we receive a valid notice
We may act on reports, legal demands, or clear violations. We are not obligated to pre-screen content. When we remove something, we aim to do so for the reasons above—not because we disagree with the writing.
6. License you grant us
By posting Your Content, you grant HearthWrite a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as needed to operate and promote the service (including caching, backups, and showing excerpts in feeds, search, and shares). This license ends when you delete the content from the service, except for reasonable residual copies (backups, caches) and content others have lawfully reshared or downloaded while it was public.
7. Feedback
If you send ideas or suggestions, we may use them without obligation to you.
8. Other people’s content
Content from other users is theirs. We do not endorse it. Report problems to [email protected] or in-product report tools when available.
9. Copyright (DMCA-style)
If you believe material on HearthWrite infringes your copyright, send a notice to [email protected] with: your contact info, identification of the work and the allegedly infringing material (URL), a statement of good-faith belief, a statement under penalty of perjury that you are authorized, and your signature. We may remove material and, in appropriate cases, terminate repeat infringers. Counter-notices may be sent to the same address.
10. Acceptable use of the service
Do not: probe or disrupt our systems; scrape in a way that harms the service or violates these Terms; impersonate others in a deceptive way; or use automated means to spam or abuse features.
11. No professional advice
Stories and community content are entertainment and expression, not legal, medical, or other professional advice.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free service, or that content will always remain available.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HEARTHWRITE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. Some places do not allow these limits; in those places, our liability is limited to the maximum allowed.
14. Indemnity
You will defend and indemnify us against claims arising from Your Content or your misuse of the service, to the extent allowed by law.
15. Payments (if added later)
If we introduce paid features, additional terms will apply at purchase. Until then, core access is as offered on the site.
16. Termination
You may stop using HearthWrite and delete your account (subject to residual backup copies). We may suspend or end access for violations of these Terms or to protect the service or users. Provisions that should survive (licenses for residual copies, disclaimers, liability limits) survive termination.
17. Changes
We may update these Terms. Material changes will be posted on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Courts located in the State of New York will have exclusive jurisdiction, except where prohibited for consumers.
